Five Ecstasy pills to be deemed `personal use'

The possession of up to five Ecstasy tablets will be designated "for personal use" and will not result in an indictment, according to a regulation formulated recently by the Justice Ministry and passed on to the Health Ministry.

The personal use definition "stems from the judicial reality in which the state has difficulty convicting people charged with drug trafficking, when the amount captured is small, amounting to a handful of pills, and the defendants claim the drug was in their possession for personal use," the Justice Ministry announced.

Justice Ministry officials said this is a case of adapting legislation to meet reality; the establishment of a maximum amount, beyond which there is no doubt that the drugs are intended for trafficking.

However, the new regulation does not make possession of up to five Ecstasy tablets legal or sanctioned. The ministry was quick to declare that "possession of fewer than five Ecstasy tablets, and even a single tablet, is a crime."
